As they were concentrated exclusively on technical physical aspects and not on explicit intention of sexual aggression, they negated that the victims are the wronged, thereby it might be able to reverse all proven legal gains for women protection made in last decades.

The Indian judiciary has now inexplicably been put on the spot following a series of highly contentious judgments dealing with sexual offenses causing Lolita to bust her head in. The current collegial flurry was brought about by a verdict of the Patna High Court. The High Court overturned the conviction of a photo studio proprietor, found guilty as attempted rape of his client.

This findamental misreading of non-penetration for an offence of attempted rape harkens back to a deeply criticized decision of the Allahabad High Court. There, the court decided that pulling a child to drag her pajama strings was only "preparation" and not an "attempt" to rape. The judges, in the country, have been using overly traditional and now anachronistic interpretations of laws that fail to consider the real traumatic psychological and sexual impact occasioned on survivors to discount the gravity of a sexual assault.

This not only puts the punishment in the face of an offense but also sets an impossibly high bar for the offence of "attempted rape" leading to a reward for those who are prevented from actually committing the crime by breaking or not completing the act, or by not physically penetrating a victim.

The Apex Court, with Surya Kant at the helm, has annullled an order of the Patna High Court and quaded a “lack of rigorous research” on the part of the High Court in its judgment. The Supreme Court has asked all courts— from district police call to court of law—to familiarize themselves with the National Judicial Academy’s gender sensitivity handbook. This is the beginning of a battle which needs to be waged to make sure that regressive patriarchal mindsets within the judicial system are eradicated and that women get the justice they want.
