The State Department and DHS are working together to cancel temporary B-1/B-2 visitor visas for foreign nationals who subsequently filed for US asylum.
The relocation would be the largest single instance of mass visa revocation in U.S. history and apply to foreigners who came to the United States on a temporary business (B-1) or tourist (B-2) visa from 2016 to 2026 and then called for protection. The use of short-term visitor visas to enter the country and then apply for asylum is a violation of the immigration system, officials say. Deputy Secretary of State Christopher Landau said asylum is not a backdoor to standard legal channels. The grassroots new plan is designed specifically to target what federal agencies call bad-faith applications.
In spite of the unprecedented nature of the range of the revocations, administration officials say that immediate, mass deportations will not occur but rather that persons with pending or active asylum claims will be stripped of their business or tourist status and quietly re-categorized administratively as their cases are processed in immigration court.
Over the last 18 months, federal officials have rescinded about 175,000 visas for reasons ranging from criminal allegations to foreign policy interests, and the administration has progressively imposed new application requirements including required disclosures of social media profiles and substantial application bonds.
But when it is, the policy is likely to be met with extensive legal blows from human rights and immigration groups. Meanwhile, as federal agencies conduct rolling reviews of applications to carry out the cancellations, the policy is already being challenged on grounds of due process and humanitarian responsibilities ُ.
